1. Acceptance of Terms

By accessing or using SparkWise Academy ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. If you are creating an account on behalf of a child, you represent that you are the child's parent or legal guardian.

2. Description of Service

SparkWise Academy is an online educational platform offering structured courses, interactive activities, graded assessments, and personalized feedback for students in grades 1 through 12. The Platform includes video lessons, interactive questions, a code editor, a virtual pet system, and a parent dashboard for tracking progress.

3. Accounts

Parent Accounts: You must create a parent account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Child Accounts: Parents create and manage child accounts. Each child account has a separate username and password. Parents are responsible for their children's use of the Platform.

Account Limits: Each subscription supports up to 3 child accounts.

4. Subscription and Payment

Free Trial: New users receive a 7-day free trial. No payment is required during the trial period. If you cancel before the trial ends, you will not be charged.

Billing: After the trial period, your subscription will automatically renew at the current subscription rate. You will be billed monthly unless you cancel.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

5. Acceptable Use

You agree to use the Platform only for lawful educational purposes. Students must not:

• Submit content that is profane, hateful, discriminatory, or otherwise inappropriate
• Attempt to circumvent content moderation or safety systems
• Share account credentials with others
• Use the Platform in any way that could harm other users or the service

Violation of these rules may result in account suspension. Repeated violations may result in permanent account termination.

6. Content Moderation and Account Suspension

The Platform automatically moderates student inputs for inappropriate content. Students who receive 3 content warnings will have their account temporarily paused. Parents will be notified and can reactivate the account after reviewing the situation with their child. All learning progress and data is preserved during suspension.

7. Intellectual Property

All content on the Platform, including but not limited to video lessons, course materials, assessments, software, graphics, and text, is the property of SparkWise Academy and is protected by copyright and intellectual property laws. You may not copy, distribute, modify, or create derivative works from our content without express written permission.

8. AI-Generated Feedback

The Platform uses artificial intelligence systems to provide feedback on student work. While these systems have been trained and refined by our educators, AI-generated feedback is provided for educational purposes and should not be considered a substitute for professional assessment. We continuously work to improve the quality and accuracy of our feedback systems.

9. Limitation of Liability

SparkWise Academy is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform's reliability, accuracy, or availability. To the maximum extent permitted by law, SparkWise Academy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

10. Modifications

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to users via email or through the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SparkWise Academy operates, without regard to conflict of law principles.
